• We reserve the right to deny services or participation in our workshops or other programs at our sole discretion with or without any cause and notice.

• Workshops involve participants taking photographs based on specific themes and prompts provided by The Expressive Lens.

• Participants are expected to engage in these activities in a respectful and creative manner, without violating the rights of others.

1.3 Online and In-Person Workshops

• Online workshops may require specific software, internet access, and technology. It is the participant's responsibility to ensure they have the necessary tools to join.

• In-person workshops will be held at designated venues. Participants are responsible for their own transportation and adherence to venue-specific rules.

2. Intellectual Property

2.1 Participant Work

• Participants retain ownership of the photographs they create during the workshops.

• By participating in a workshop, you grant The Expressive Lens a non-exclusive, royalty-free, irrevocable, worldwide license to use, reproduce, display, and promote your photographs for marketing, educational, and promotional purposes. If you prefer not to have your work used, please inform us in writing prior to or during the workshop.

2.2 The Expressive Lens Content

• All content provided by The Expressive Lens during workshops, including themes, prompts, educational materials, and photography guidance, is the intellectual property of The Expressive Lens.

• You may not copy, distribute, or reproduce any content provided during workshops without our written permission.

3. Photography of Participants

3.1 Consent to Photography

• During workshops, whether online or in person, The Expressive Lens may take photographs or record videos of participants for use on our website, social media, and promotional materials.

• By participating in our workshops, you consent to being photographed or recorded. If you do not wish to appear in photos or videos, please notify us before the workshop begins so we can accommodate your preferences.

4. Payments and Refunds

• Workshop registration fees must be paid in full at the time of booking. The fee covers participation in the workshop, access to workshop materials where deemed appropriate by us, and any other services described during registration.

5. Code of Conduct​

5.1 Participant Behavior

• We strive to create a positive, inclusive, and creative environment in all our workshops. Participants are expected to treat others with respect and refrain from disruptive, offensive, or discriminatory behavior.

• The Expressive Lens reserves the right and sole discretion to remove participants from any workshop if their behavior is deemed inappropriate or disruptive. No refunds will be provided in such cases.

5.2 Online Workshop Etiquette

• Participants in online workshops must ensure that their behavior and contributions adhere to the same respectful guidelines. Any misuse of the platform or inappropriate conduct may result in removal from the workshop without any warnings, prior notices or refunds.

The services provided by The Expressive Lens, including but not limited to our website, online courses, in-person workshops, and any related materials, are offered on an "as-is" and "as-available" basis. The Expressive Lens makes no representations or warranties of any kind, express or implied, regarding the operation of these services or the information, content, materials, or products included therein. 

To the fullest extent permitted by applicable law,The Expressive Lens disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, or availability of the services. We do not guarantee that:

6.1. The services will be uninterrupted, timely, secure, or error-free;

6.2. Any defects or errors will be corrected;

6.3. The results obtained from the use of the services will be accurate or reliable;

• Participants are responsible for their own safety and well-being during in-person workshops, including during any photography outings or activities. The Expressive Lens is not liable for any injuries, accidents, or damages that may occur during participation.

• Participants are also responsible for the security and maintenance of their personal belongings, equipment, and digital data.

7.2 No Guarantee of Results

• The Expressive Lens aims to provide educational and creative opportunities through its workshops, but we do not guarantee any specific outcomes or results in terms of skill development or artistic achievement.

7.3 Limitation of Liability

• Limitation of Liability: To the fullest extent permitted by applicable law, The Expressive Lens, its affiliates, directors, employees, agents, or partners shall not be liable for any loss whether direct or indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of, or inability to access or use, our website, online courses, in-person workshops, or any related services; (b) any conduct or content of any third party on the website or in the services; (c) any content obtained from our services; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. In no event shall our total liability to you for all claims related to the services exceed the amount paid by you, if any, to The Expressive Lens for the specific services giving rise to such liability during the three (3) months preceding the event giving rise to liability.By using our services, accessing our website, interacting with us, participating in our workshops and programs, purchasing any other product or service offered by us, you acknowledge that you understand and agree to these limitations of liability. If you are dissatisfied with any aspect of our services, your sole and exclusive remedy is to discontinue using the services.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any dispute arising out of or in connection with these Terms of Service, our services, programs, courses etc. including any disputes regarding the validity, interpretation, or performance thereof, shall be subject to the exclusive

 jurisdiction of the courts located in Chennai, Tamil Nadu, India.

 

11. Force Majeure

The Expressive Lens shall not be liable for any failure or delay in performing its obligations under these Terms of Service if such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, explosion, war, terrorism, civil unrest, governmental action, labor strikes or shortages, transportation interruptions, pandemics, epidemics, or any other event that constitutes a force majeure. In the event of such a force majeure, obligations of The Expressive Lens will be suspended for the duration of the event, and The Expressive Lens shall make reasonable efforts to resume performance as soon as practicable. However, if the event of force majeure continues for more than 30 days, either party may terminate the affected services upon written notice to the other party without any liability, except for any payment obligations for services already rendered.
